Additional Terms – Tes magazine for institutions

Tes offers School-wide Magazine Subscriptions to its Institution customers via the Tes magazine School-wide Subscriptions Websites (as defined below).

Introduction

These Additional Terms govern your purchase from Tes of a School-wide Magazine Subscription from https://www.tes.com/for-schools/empower/magazine-school-subscription (the “Tes Magazine School-wide Subscriptions Websites”), and should be read in conjunction with our General Terms found here.

Please read both these Additional Terms and the General Terms carefully before purchasing a School-wide Magazine Subscription. By purchasing a School-wide Magazine Subscription, you confirm that you accept the General Terms and these Additional Terms and that you agree to comply with them. You will (and you will also procure that all Users at your Institution will) comply with these Additional Terms (as amended from time to time). Capitalised terms used but not otherwise defined in these Additional Terms have the meaning given to them in the General Terms.

These Additional Terms and the General Terms (and any additional agreements referred to or contemplated in each of the foregoing) represent the entire agreement between you and us. In the event of a conflict between the General Terms and the Additional Terms, these Additional Terms shall prevail over the General Terms.

Without prejudice to our powers under the General Terms, you agree that we, at our sole discretion, without notice to you, may terminate or amend the General Terms or these Additional Terms at any time.

  • By placing an order for a Organisation-wide Magazine Subscription on the Tes Magazine Organisation-wide Subscriptions Websites, you warrant that you are (i) legally capable of entering into binding contracts; and (ii) over the age of 18 years. If we reasonably believe that you are not over the age of 18, we reserve the right to cancel your order.

     

  • To use your Organisation-wide Magazine Subscription, each of your members of staff will need to create a tes profile using their Institutional email address at https://www.tes.com/magazine. Logging into tes with this profile gives your staff full access to the magazine.

    Your Organisation-wide Magazine Subscription, unless specifically stated otherwise, will be personal to your Institution. You are granted a non-exclusive, non-transferable right to access the relevant content from the date of the Organisation-wide Magazine Subscription. You are not permitted to share your Organisation-wide subscription account credentials with any person who is not a member of staff at your Institution.

    Some of our Organisation-wide Magazine Subscriptions offered to Institutions limit the number of Users that may access the relevant content. You are only permitted to share or provide access to your Organisation-wide Magazine Subscription to the number of Users that have been agreed with us as part of your Organisation-wide Magazine Subscription. 

     

     

  • To purchase a Organisation-wide Magazine Subscription you must complete the ‘Contact us’ form on the Tes Magazine Organisation-wide Subscriptions Websites. We will then contact you via phone or email to provide you with a quotation for the cost of your Organisation-wide Magazine Subscription. Once you have accepted this quotation and informed us that you would like to proceed with your Organisation-wide Magazine Subscription, you will be invoiced along with a confirmation email of your subscription to the email address you have supplied on the ‘Contact us’ form.

     

  • The price of your Organisation-wide Magazine Subscription will be worked out based on the type of organisation and number of staff that you wish to access the relevant content and will be quoted to you from the Tes Subscriptions Team once you have filled in the ‘Contact us’ form on the Tes Magazine Organisation-wide Subscriptions Websites. Prices are exclusive of VAT. Prices are liable to change at any time. In the event that the price of our Organisation-wide Magazine Subscription changes, we will notify you via email. The change in price will take effect either: (i) from the date of your next payment date; or (ii) 28 days from the date we notify you, whichever is later.   

     

    If the Tes Magazine Organisation-wide Subscriptions Websites contains incorrect information, or an Organisation-wide Magazine Subscription is offered to you at an incorrect price, due to typographical errors or an error in pricing information, we shall not be under any obligation to fulfil the Organisation-wide Magazine Subscription to you at the incorrect price, even after we have accepted your order, if the pricing error was obvious to a reasonable person. If payment has already been taken for the purchase and your Organisation-wide Magazine Subscription is cancelled, we shall immediately issue a credit or refund in the amount of the incorrect price.  Alternatively, we will give you the option of reconfirming your order at the correct price.

  • Payment can be made by credit or debit card, or bank transfer.

     

    If we have not received payment within fourteen (14) days of your invoice being sent, we may temporarily or permanently suspend your Organisation-wide Magazine Subscription and we shall be under no obligation to provide any or all of the services relating to the Organisation-wide Magazine Subscription while any payments remain unpaid.

  • The digital products in your Organisation-wide Magazine Subscription will be available via your online account at www.tes.com shortly after your order has been accepted.

     

  • Your Organisation-wide Magazine Subscription shall commence on the date we send you an email confirming acceptance of your order and shall continue until terminated in accordance with the below "Terminating your Organisation-wide Magazine Subscription" clause.

     

     

  • Either party may terminate your Organisation-wide Magazine Subscription at any time by giving the other party notification by telephone of termination. We may also terminate your Organisation-wide Magazine Subscription at any time by giving you written notice of termination. Termination will take effect from the date of the notification. If you terminate shortly before the date your next payment is due then you may still be debited for your Organisation-wide Magazine Subscription. However, you may be able to claim a refund in accordance with our "Refunds Policy" set out below. 

    To terminate your Organisation-wide Magazine Subscription please call 0345 521 7111 (if outside the UK, +44 (0)203 194 3164).

    If you have not paid for your Organisation-wide Magazine Subscription within 14 days of the due date for payment, in addition to the above termination rights, we are entitled to immediately terminate your Organisation-wide Magazine Subscription.

  • On termination of your Organisation-wide Magazine Subscription, you will no longer have access to or be permitted to access your digital magazine content and you will no longer receive print copies of Tes magazine.

  • If you terminate your Organisation-wide Magazine Subscription by calling us as outlined above, either within 14 days of: (i) the date on which you were sent an email confirming acceptance of your order; or (ii) the date of your latest payment (the "Refund Period"), we will refund you the cost of the last payment you have made in respect of your Organisation-wide Magazine Subscription. No refunds are available in respect of digital-only Organisation-wide Magazine Subscriptions.

    After the Refund Period, no refunds will be available and you will only be able to terminate your Organisation-wide Magazine Subscription in the manner set out above.
